Form I-765 is the gateway to your Employment Authorization Document (EAD). Even small errors can trigger a Request for Evidence (RFE), adding months to your processing time, or result in an outright denial.

The Top 10 Mistakes

1. Wrong Eligibility Category. This is the most critical field. Selecting the wrong (c) category for your situation — for example, choosing (c)(3)(C) for STEM extension when you should have chosen (c)(3)(A) for initial OPT — will result in denial.

2. Name Discrepancies. Your name on Form I-765 must match your passport, I-20, and I-94 exactly. Even small differences (middle name vs. middle initial) can cause delays.

3. Missing or Expired Passport Photos. USCIS requires two identical 2x2-inch photos taken within the last 30 days. Using older photos or the wrong size is a common rejection reason.

4. Filing Outside the Window. For OPT, your application must be received by USCIS within the 90-day-before to 60-day-after window from your program end date. Postmark date does not count.

5. Incomplete I-20. Your I-20 must have the OPT or STEM extension recommendation from your DSO before you file. Filing without this recommendation guarantees denial.

6. Unsigned Forms. USCIS will reject any form that is not signed. Double-check that you have signed and dated Form I-765 before mailing.

7. Wrong Filing Fee. The I-765 filing fee changes periodically. Using an old check amount will result in rejection. Always verify the current fee on uscis.gov.

8. Missing I-94 Record. Your I-94 must show your most recent entry in the correct status. Download it from i94.cbp.dhs.gov and include it with your application.

9. Incorrect SEVIS Number. Your SEVIS number starts with N followed by 10 digits. Transposing digits is more common than you think.

10. Not Making Copies. Always photocopy your entire application package before mailing. If anything is lost, you will need these copies.
