Arrested Once, Years Ago: Can I Still Apply for Citizenship?
Short answer: maybe, but this is the situation where checking first matters most. An old arrest does not automatically block citizenship, but the N-400 asks about it, and the answer depends on what happened. Many people with a minor or dismissed case can still apply. Some outcomes can put your green card at risk, so talk to an attorney before you file.
What to know
- The application asks about arrests, citations and detentions. People commonly believe that a dismissed, expunged or sealed case does not count. It can still be asked about, so do not assume you can leave it out.
- What matters is the full story: what the charge was, how it ended, how long ago, and what your record has looked like since.
- Leaving a case off the form is often worse than the case itself.
You may be able to file alone if
- The case ended with no charge or was dismissed, it was a long time ago, and you have a clean record since.
- You have the court papers showing how it ended.
See an attorney first if
- You were convicted of anything, or you are not sure how the case ended.
- The charge involved drugs, violence, theft, fraud or domestic issues.
- You were arrested more than once, or at any time since you became a resident.
- You have no paperwork showing what happened. A lawyer can help get it.
Many nonprofits and some New York programs offer a free or low-cost review of a record. That costs far less than a denied application.
