Can I Renew My Work Permit (EAD) or Extend a Visitor Stay Myself?
Short answer: often yes for both, because these are short forms with a clear set of requirements. Two things cause most problems: filing too late, and assuming an old rule still applies. Rules for work permits have changed recently, so check the date and your category before you rely on any extension.
Work permit (EAD renewal, Form I-765)
- Most people renew in the same category they already hold (for example DACA, a pending green card, or a student on OPT) and can file alone if nothing in their situation has changed.
- File early. Renewals are accepted well before the card expires, and processing can take months.
- Check the automatic-extension rule. USCIS has announced the end of automatic extensions for certain EAD renewals, so do not assume you can keep working after the card expires. Confirm the rule for your category. See the USCIS announcement.
Visitor extension (Form I-539)
- A visitor who needs more time generally files before the authorized stay on the I-94 ends. See USCIS: Extend Your Stay.
- Extensions are for a real, temporary reason, such as an illness, a delayed flight or a family event, and you must show you will leave.
- Late filing and unlawful stay can have serious effects. If your stay has already ended, see an attorney first.
See an attorney first if
- Your status or authorized stay has already expired.
- You have had a denial, an arrest, or an unauthorized job.
- You want to switch from visitor to something else (student, worker, spouse). That is a change of status, not an extension, and it is riskier.
- Your EAD category has complicated rules, or you are not sure which category you fall under.
