USCIS can deny a filing for missing evidence without sending a Request for Evidence first

Effective August 5, 2026, USCIS updated its Policy Manual (chapters E.6, E.9, E.10) to let officers deny an immigration benefit request when required initial evidence is missing at filing, without first issuing a Request for Evidence (RFE) or Notice of Intent to Deny (NOID). Under the prior guidance, officers were generally directed to issue an RFE or NOID before denying an incomplete case. The change applies to applications pending on, or filed on or after, that date. The update also states that when an RFE is issued its response period no longer defaults to the maximum 12 weeks, removes the extra 14 days USCIS had added for applicants outside the U.S., and treats any partial response as a request to decide the case on what was submitted.
